Website terms v6.0

Event Entry, Participation & Guest Terms

By creating a TPT account you confirm that you have read and accept these terms. Account creation alone is not a confirmed event booking.

1. Organiser, venue and scope

“TPT” means The Padel Tour Pty Ltd, trading as The Padel Tour, physical service address 649 Borzoi Street, Garsfontein, Pretoria, email hello@thepadeltour.co.za. Privacy contact: hello@thepadeltour.co.za. Each event notice identifies its organiser, venue operator, address, event date, hours, price, eligibility criteria and included services.

These terms govern TPT event registration, bookings and TPT-controlled event activities. They apply to players and, where relevant, spectators, accompanying family, friends and other guests who accept them. Venue rules must also be made available before entry. A label such as “independent venue” does not remove any party’s legal responsibility.

2. Acceptance and document priority

Each adult player must accept the current terms, prominent risk notice and applicable event documents personally before payment or participation. One person may pay for a pair, but may not accept another competent adult’s personal risk terms. Account creation alone is not a confirmed event booking.

Each adult guest must receive the risk notice and give their own acknowledgement before admission to TPT-controlled event areas. Parents or legal guardians follow section 7 for minors. Free attendance does not remove the need to communicate material risks.

Mandatory law takes priority. These terms govern booking and attendance; the event bulletin governs expressly stated event-specific sporting arrangements; the player rulebook governs remaining sporting matters. Identify any permitted rulebook variation before payment. TPT must resolve material inconsistencies rather than rely on hidden precedence clauses.

Terms are available to view, download and retain before acceptance. TPT records the accepted version and sends or links to a durable copy in the confirmation. Material changes are not imposed retrospectively through a website update; fresh acceptance and fair alternatives will be provided where required.

3. Eligibility, partner information and confirmation

Provide accurate names, contacts, partner details, ratings and other necessary entry information. TPT may check relevant ratings and results and assess unrated players under the published process. Deliberate misrepresentation, impersonation or concealment of ability may lead to reassignment or disqualification after a fair review. Any financial consequence remains subject to section 4 and applicable law.

Each partner must qualify under the published TPT League Index and assessment process. The pair enters at or above the higher partner’s minimum eligible division. Event documents specify exact boundaries, substitution deadlines and age requirements. TPT may not introduce undisclosed material eligibility conditions after payment without an appropriate remedy.

A place is confirmed only after both partners are eligible, each required acceptance is recorded and full payment is received. Unless the event notice states otherwise, a provisional place is held for 48 hours from the payment request, or until the stated entry deadline if earlier. Expiry releases the place; any money received must be reconciled promptly.

Incomplete pairs and unpaid applicants remain provisional. Waiting-list order, offer expiry and any published eligibility priorities must be applied consistently. A replacement player needs independent eligibility approval and acceptance before participating. Entries may not be privately transferred without approval.

4. Prices, player cancellations and refunds

The checkout must show the total payable, taxes and compulsory charges, included services, advertised match entitlement, material exclusions and cancellation schedule before payment. TPT does not guarantee winning, prizes not expressly promised, a particular opponent or completion where a lawful safety interruption prevents play. This does not remove advertised service obligations or consumer remedies.

Notify cancellations through hello@thepadeltour.co.za; TPT acknowledges receipt and provides an itemised decision. A reasonable cancellation charge may reflect notice given, the nature of the booking, demonstrable unrecoverable costs, the ability to fill the place and normal industry practice. It will not exceed a disclosed schedule or a lower amount required by law. TPT will account for replacement income and avoid duplicate recovery.

No blanket “all payments non-refundable” rule applies. No cancellation charge is imposed where section 17 of the Consumer Protection Act prohibits it, including qualifying death or hospitalisation circumstances. TPT requests only proportionate supporting evidence, handled confidentially. Each event must publish an attorney-reviewed cancellation schedule before sales open.

Unless law requires otherwise, approved refunds are initiated within 10 business days after the decision, to the original payment method where practicable. Actual bank settlement times may vary. No-show or late-arrival charges are subject to the same statutory reasonableness limits. Credits are not imposed in place of refunds where a refund is legally due.

5. Event changes, interruption and non-delivery

TPT may reasonably delay, suspend, relocate or change play to address weather, unsafe courts, medical emergencies, power failures or comparable disruption. Safety takes priority. TPT will communicate the reason, revised arrangements and consequences as soon as reasonably practicable.

For cancellation, material relocation or postponement, TPT will explain the available options and any refund required by law. A credit, replacement date or reduced service is not automatically the sole remedy. For partial delivery, any lawful deduction must be fair, explained and linked to services actually delivered and applicable law. Force majeure is not a blanket right to retain all fees.

Travel and accommodation are booked independently unless expressly included. Participants should consider suitable cover and flexible arrangements. This provision does not exclude losses TPT must compensate by law.

6. IMPORTANT — sporting and spectator risks

Padel involves rapid movement, changes of direction, falls, collisions with players, rackets, balls, glass, fences and gates, equipment failure, physical exertion, heat and outdoor weather exposure. Injuries can include sprains, fractures, concussion, eye injury, serious disability and, exceptionally, death. Balls or rackets may leave the playing area and injure spectators. Parking and shared access areas have vehicle and trip hazards. Reasonable precautions cannot eliminate every risk.

By separately acknowledging this notice, you confirm that you understand these risks and voluntarily participate or attend subject to your legal rights. Acceptance of inherent sporting risk is not acceptance of defective facilities, undisclosed avoidable hazards or unlawful conduct. You may ask questions before accepting and decline participation or leave an unsafe area. A fair opportunity to read and understand this notice must precede payment or admission, whichever occurs first.

7. Family, friends, spectators and minors

Inform your invited guests of the event access process and send them the terms and risk notice. Each competent adult guest accepts for themselves. Inviting a guest does not make you automatically liable for their independent conduct or allow you to waive their rights. Liability for your own conduct remains governed by law.

Spectators must stay behind designated barriers, keep clear of gates and emergency routes, follow safety instructions and never enter an active court without permission. No spectator should stand where an official identifies an unsafe position. Pets, alcohol, restricted areas and capacity limits follow the disclosed venue rules. TPT and the venue may restrict access proportionately for safety or capacity.

A parent or legal guardian must verify their authority, identify the minor and consent to participation or attendance and the necessary lawful processing of the minor’s information. A player or other adult who is not the guardian must provide the required guardian authorisation; merely bringing a child is insufficient. No clause requires a guardian to surrender a child’s non-waivable rights or indemnify TPT for TPT’s unlawful conduct.

Unless a separate supervised programme is expressly agreed, the accompanying parent, guardian or authorised carer remains responsible for the child’s supervision and collection. TPT does not offer general childcare. Children must remain away from active courts unless authorised to play. Safeguarding concerns must be reported to the named event contact, without restricting direct reporting to authorities. Medical-treatment consent must comply with applicable law; a generic signature does not replace it.

8. Player fitness, equipment and conduct

Assess your fitness and seek medical advice when appropriate. Do not play while impaired, acutely unwell or unable to participate safely. Use suitable footwear, serviceable equipment and a correctly secured racket wrist strap. Disclose only information reasonably necessary for a specific emergency, safety adjustment or accessibility need through the confidential channel provided.

Follow lawful instructions, scoring procedures, time limits and published conduct rules. Abuse, harassment, discrimination, violence, deliberate dangerous play, fraud and unauthorised court entry are prohibited. Report hazards and injuries promptly; do not attempt to repair venue infrastructure yourself.

TPT may stop play or remove a person where reasonably necessary for immediate safety. Other disciplinary decisions should state the reason and allow a fair opportunity to respond where practicable. Removal does not automatically forfeit all payments or eliminate a right of review. TPT may seek recovery of proven damage caused unlawfully by a person, subject to fair process and law.

9. Venue responsibilities and TPT responsibilities

Under the separate signed venue agreement, the venue operator is required to take responsibility for premises and venue operations within its control: court structures, glass, fencing, gates, turf, fixed lighting and electrical installations; maintenance and inspections; venue-controlled spectator areas, toilets, parking and access; venue licensing, occupancy, emergency access and agreed on-site support; and appropriate venue public liability insurance.

TPT is responsible for its organising activities within its control, including entry administration, eligibility, draws, scheduling, communications, TPT-appointed personnel and equipment, and event coordination. First aid, security, emergency command and stoppage authority must be expressly allocated in the event plan. TPT will act on hazards it becomes aware of and suspend unsafe play where necessary.

This allocation does not bind an injured person to claim only against the venue, prevent claims against a legally responsible party, or transfer a non-delegable statutory duty. Vendors and contractors remain responsible for their own services, but their separate status does not defeat any responsibility imposed on TPT by law.

10. Emergency response

Follow the event emergency plan and keep emergency access clear. TPT may summon emergency services, contact your nominated emergency contact and share information reasonably necessary for assistance where lawful. This is not unrestricted consent to treatment and does not override statutory consent requirements.

First aid is not a guarantee of medical treatment or recovery. You remain responsible for medical expenses legally payable by you, without shifting costs for which TPT, the venue or another party is legally liable. The event notice identifies the safety lead and first-aid point; emergency-contact data is not used for marketing.

11. IMPORTANT — liability limitations

Nothing excludes, limits or waives liability that cannot lawfully be excluded, including liability for gross negligence, fraud, wilful misconduct, applicable statutory product liability, or any mandatory consumer remedy. No clause excludes ordinary negligence causing death or personal injury. TPT remains liable to the extent required by law for its own conduct and for persons for whom it is legally responsible.

To the extent lawful and fair, TPT is not liable for loss caused solely by an inherent sporting risk that remains despite reasonable precautions, or by an independent third party for whose conduct TPT is not legally responsible. TPT does not undertake custody of unattended possessions unless expressly accepted; this is not an exclusion of loss caused by TPT’s legally actionable conduct.

To the extent lawful, fair and applicable to the particular claim, TPT excludes indirect business losses, such as lost business opportunity or business profit. For a claim solely for non-injury economic loss arising from TPT’s ordinary contractual breach, TPT’s aggregate liability is limited to the amount paid or payable to TPT for the affected booking. This cap does not apply to refunds legally due, death or personal injury, physical property damage, privacy or data-protection liability, gross negligence, fraud, wilful misconduct or any liability that may not lawfully be limited. If the cap would be unlawful or unfair, it does not apply.

These limits apply only to TPT and persons acting lawfully within their TPT roles. A venue’s own protections must be disclosed separately and remain subject to law. Participants retain the right to challenge the application or fairness of any limitation.

12. IMPORTANT — limited indemnity for your own wrongdoing

To the extent permitted by law, you indemnify TPT against reasonable, proven third-party loss and necessary legal costs to the extent caused by your intentional unlawful conduct, negligent damage or material unlawful breach of these terms. Liability is apportioned according to responsibility; no amount is recovered twice.

This does not require you to cover TPT’s or the venue’s own negligence, another adult guest’s independent acts merely because you invited them, a child’s conduct solely because you are their guardian, or liabilities that cannot lawfully be transferred. TPT must give prompt notice of a claim, allow a reasonable opportunity to respond, mitigate loss and not settle at your expense without reasonable consultation and your consent, not unreasonably withheld.

13. Privacy, communications and images

The separate privacy notice identifies the responsible party, purposes, lawful grounds, recipients, retention criteria, safeguards, rights and complaint channels, including the Information Regulator. Collect only necessary information. Health information and children’s information require the applicable additional protections. Access is limited to authorised persons who need the information.

Booking, safety and event messages are service communications. Sponsor marketing, sponsor data sharing and TPT promotional subscriptions require separate, specific choices where consent is relied on. Boxes must be optional, unticked and withdrawable. Entering or bringing a guest does not authorise disclosure of a database to sponsors.

Tell attendees in advance about event photography, results publication and any filming areas. Use the lawful basis stated in the privacy notice for limited operational coverage; obtain separate permission for featured promotional use where required. Offer a workable image-objection channel and reasonable practical accommodations, while explaining that complete exclusion from wide crowd images cannot always be guaranteed. Obtain appropriate guardian authorisation for minors. Do not publish sensitive health or emergency-contact information.

14. Decisions, complaints and legal remedies

The designated tournament director decides sporting issues under the published rules and protest deadlines. Finality for administering a match or draw does not remove legal remedies for booking, safety or statutory complaints. Safety concerns may be raised immediately and need not await a match protest.

Send complaints to hello@thepadeltour.co.za. TPT aims to acknowledge within two business days and respond substantively within 10 business days, or explain why more time is needed. These service targets do not suspend statutory rights or impose a shortened legal claim deadline.

South African law applies, subject to mandatory rights. No compulsory private arbitration, exclusive distant court or “final and binding” wording removes access to an appropriate court, regulator, ombud or tribunal. An invalid provision is severable only to the extent that the remainder can operate lawfully and fairly. Contractual changes require lawful notice and acceptance where necessary.

Aligned event information and shirt purchases

The opening is proposed for 14 November 2026 at Thrashers, Pretoria: 30 pairs, 10 per division, R600 per player, four scheduled pool matches per pair plus semifinals/finals for qualifiers. The dated event bulletin governs sporting detail. Shirts are optional, separately purchased at signup and are not included in the entry fee. The optional personalised shirt costs R350 and includes the player’s chosen name. Entry plus one shirt totals R950 per person; there is no bundle discount. Checkout must show the approved shirt price, sizing, order deadline, delivery and lawful cancellation terms before purchase. Reserve shirt receipts for fulfilment. Do not assume a standard-size shirt is legally non-refundable merely because it has an event logo.

Venue responsibility and accompanying guests

Venue partners undertake responsibility for premises and venue operations under their written agreement with TPT. TPT remains responsible for its own organising activities and duties imposed by law. This contractual allocation does not bind an injured attendee or remove a statutory right. Players must share the guest notice with accompanying friends and family, but cannot accept another competent adult’s personal risk terms. TPT-controlled event areas require each adult guest’s own acknowledgement and an appropriate guardian process for minors; coordinate access controls with the venue. Apply the risk notice and acceptance provisions above to each attendee category.

Sporting document reference

The applicable player reference is TPT Player Rule Book First Edition v1.2, together with the dated event bulletin. Contractual terms do not replace its sporting rules. Event administration targets do not remove its 24-hour recording-error and administrative complaint routes. Any material sporting change must be communicated directly before play with fair remedies where applicable. The separately approved privacy notice must be linked before signup; marketing acceptance is optional and separate.

Personalised shirt purchase and price disclosure

Approved commercial direction: R600 event entry per player (R1,200 per pair). Optional TPT shirt: R350 each, including the player’s name. Entry plus one shirt: R950 per player; two entries plus two shirts: R1,900. No shirt is compulsory and no bundle discount is offered. Event sporting provisions remain subject to the approval record.

Before payment, show the shirt design, size chart, name-printing position and character limit, order cutoff and collection arrangements. The buyer must approve size and exact name spelling. No production starts before payment and proof approval. Explain any restriction on changes after production is committed, subject to applicable consumer law. TPT remains responsible for supplier errors, defects and statutory remedies; do not use a blanket no-refund clause.

The final payable amount, applicable taxes and any unavoidable charges must be visible before payment. Personalisation data is used for fulfilment, shared only as necessary with the supplier, and is not permission for sponsor marketing. Entry cancellation and shirt cancellation are assessed separately under the disclosed terms and applicable law.

Funded prizes and player welcome

Funded prize allocation: R25,000 total, comprising R24,000 in competition prizes and a R1,000 event-wide Spirit of TPT award. Each of the three divisions receives R8,000: winners R4,000 per pair; runners-up R2,500 per pair; joint third R750 per losing semifinalist pair (two pairs). Awards are per pair, not per player. There is no bronze playoff and no change to the court schedule.

A separate funded R5,000 player-welcome and experience budget covers all 60 players (approximately R83.33 per player). Planning allowances: useful take-home items R2,400; arrival water and snacks R1,500; welcome cards, next-event QR and simple packaging R500; delivery and contingency R600. These are purchasing caps, not supplier quotes or guaranteed pack contents. Confirm specifications and quantities before promising individual items.

Spirit of TPT: one R1,000 event-wide award to an individual player, irrespective of placing, for sportsmanship, encouragement and fair play. No random draw or extra purchase. Nominations may be submitted to the event desk before the finals. The Tournament Director and player-experience lead assess recorded examples against those criteria, disclose conflicts and document the decision; if tied, prioritise the clearest contribution to other players’ experience.

Finance will publish payment timing before entries open (proposed: verified awards paid within five business days after the event). Obtain signed pair payment instructions and pay each player half unless both authorise a different split. Verify results before release, retain payment evidence and publish any lawful tax information. If play is interrupted, do not infer cash awards from ranking-point rules: apply a pre-published, approved cash-prize completion policy without retrospective changes or blanket forfeiture.

“R25,000 in total cash awards: R24,000 in competition prizes across three divisions, plus a R1,000 Spirit of TPT award. Each division: winners R4,000 per pair; runners-up R2,500 per pair; joint third R750 per pair. Every player receives a goodie bag. Entry R600 per person; optional personalised TPT shirt R350; entry plus shirt R950. Bragging rights included. Your partner’s excuses sold separately.”
